Innovative Marketing Within Legal Parameters

Health care providers, including infusion providers, are highly regulated by federal and state laws. This is because a large portion of the reimbursement paid to providers is directly/indirectly tied to taxpayer money. From a marketing standpoint, what is acceptable in the non-health care world may be prohibited in the health care world. This program will discuss how infusion providers can implement innovative marketing programs…while complying with federal and state guidelines. We will discuss (i) the federal anti-kickback statute, (ii) the federal physician self-referral statute (“Stark”), (iii) the federal beneficiary inducement statute, (iv) HIPAA marketing restrictions and (v) examples of their state counterparts. Equally as important, this program will (i) present real world case studies of proper and improper marketing initiatives and (ii) discuss advertising language that is acceptable…and language that is unacceptable.
